These Terms & Conditions (“Terms”) govern your access to and use of the Site and your purchase or subscription to our products (“Products”). By using the Site or purchasing, you agree to these Terms and to our Privacy Policy (UK/EU GDPR-aligned). If you do not agree, please do not use the Site.

2. Definitions

•Account: your customer profile on the Site.

•Subscription: an auto-renewing purchase plan for Products.

•Working Day: Monday–Friday, excluding UK public holidays.

•EEA: the European Economic Area.

3. Eligibility & territory

You must be 18+ and able to form a binding contract. We ship to the UK, EU, and US (see Shipping). Some features or offers may be limited by territory.

4. Changes to these Terms

We may update these Terms occasionally. We’ll post the new date at the top; material changes may be notified by email or Site banner. Continued use after changes means you accept them.

5. Your account

Keep your login details confidential and your information accurate. You’re responsible for all activity under your Account. We may suspend or close Accounts for misuse or suspected fraud.

6. Product information & health disclaimer

Somno Products are food supplements. They are not medicines and are not intended to diagnose, treat, cure, or prevent disease. Content on the Site is educational and not medical advice. Consult a healthcare professional before use if you are pregnant, breastfeeding, taking medication, or have a medical condition. Follow on-pack directions. Results vary.

7. Ordering & contract formation

Placing Products in your basket and completing checkout constitutes an offer to buy. We’ll acknowledge receipt by email, but the contract forms when we dispatch the Products and send a dispatch confirmation. We may reject or cancel orders (e.g., suspected fraud, stock issues, pricing errors). If we cancel after payment, we’ll refund you promptly.

8. Pricing, taxes & currency

Prices are shown in GBP/EUR/USD and include VAT where applicable. Shipping costs and any import duties/taxes (outside the UK/EU) are shown or referenced at checkout. We may change prices at any time; changes do not affect orders already accepted.

9. Payment methods

We accept major cards (Visa, Mastercard, Amex), Shop Pay, Apple Pay, Google Pay, and other methods shown at checkout. You authorise us (and our payment processors) to charge your selected method for order totals and any Subscription renewals.

10. Subscriptions (auto-renewal)

•Subscriptions auto-renew each billing cycle until cancelled.

•You can cancel anytime before the next renewal charge in your customer portal or by emailing support@drinksomno.com.

•We’ll notify you of material price or frequency changes in advance.

•Failed payments: we may retry, pause, or cancel the Subscription.

11. Shipping & delivery

Where we ship: UK, EU, US.

Timing: Estimated delivery windows are shown at checkout and in your dispatch email. Estimates are not guarantees; delays can occur from customs, carriers, weather, or events beyond our control.

Risk & title: Passes to you on delivery to the address provided.

Address errors: Please check your details; we’re not responsible for mis-delivery due to incorrect addresses.

Customs (non-UK/EU): You are the importer of record and responsible for duties/taxes where applicable.

12. Right to cancel (UK/EU consumers)

If you are in the UK/EEA, you may have a statutory 14-day right to cancel most distance purchases from delivery without giving a reason. To exercise, follow the instructions on our Returns page or email us. This statutory right co-exists with our commercial policy below.

13. Returns & refunds (commercial policy)

We offer a 30-day return window from delivery. Please see the Returns Policy page for instructions, conditions (e.g., unopened/unused in original packaging unless defective), and whether return postage is covered. Refunds go to the original payment method after inspection. Shipping charges are typically non-refundable, unless required by law or our policy.

14. Faulty or mis-described items

If a Product is defective or not as described, contact support@drinksomno.com with photos and your order number. Your legal rights under consumer law are unaffected. Where verified, we will repair, replace, or refund within a reasonable time.

15. Promotions, discount codes & gifts

Promotions and codes: single-use, non-transferable, subject to expiry, cannot be combined unless stated. We may modify or withdraw offers. Minimum spends, territory limits, or product exclusions may apply. Free gifts are subject to stock and may be substituted or withdrawn.

16. User content (reviews, photos, feedback)

By submitting reviews, images, videos, testimonials, Q&A, or feedback (“User Content”), you grant Somno a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable licence to use, reproduce, adapt, publish and display the User Content (including first name/initials and region) in any media for marketing, analytics, and customer support.

You confirm you own the rights and your User Content is lawful, accurate, and non-infringing. We may moderate or remove User Content at our discretion.

17. Acceptable use & anti-scraping / AI

You must not:

•use bots, scrapers, crawlers, or other automated means (except search engines respecting robots.txt) to access the Site;

•copy, ingest, or use Site content, visuals, data, or pricing to train or improve any AI or machine learning models;

•upload malware, attempt unauthorised access, or interfere with security;

•infringe IP rights or privacy;

•harass, discriminate, or post unlawful content;

•resell Products without our written permission.

We may suspend or terminate access for breach.

18. Intellectual property

All Site content (text, graphics, logos, images, videos, packaging designs, and trademarks) is owned by or licensed to Somno and protected by applicable laws. You may use the Site for personal, non-commercial purposes only. No licence is granted beyond that necessary to browse and purchase.

19. Email & SMS marketing (PECR/GDPR)

If you opt in, we may send you email and/or SMS about Somno (order updates, offers, reminders, review requests). Consent is not a condition of purchase.

•Email: unsubscribe via the link in any email.

•SMS (UK/EU): reply STOP to opt out; HELP for help.

We process your data per our Privacy Policy and UK/EU GDPR and UK PECR rules.

20. Data protection

We process personal data as a controller under UK GDPR/EU GDPR. See our Privacy Policy for lawful bases, retention, international transfers, and your rights (access, deletion, objection, portability, etc.).

21. Accessibility

We aim to conform to WCAG 2.1 AA where feasible. If you need these Terms or other policies in an alternative format, contact support@drinksomno.com.

22. Warranties & disclaimers

The Site and Products are provided “as is” and “as available” to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free access. Nothing in these Terms affects your statutory rights.

23. Our liability

To the maximum extent permitted by law, Somno’s total liability for any claim relating to a purchase shall not exceed the price you paid for the affected Product(s).

Nothing limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law. Your statutory rights remain unaffected.

24. Third-party tools & links

We may provide access to third-party tools or link to third-party sites. These are provided “as is”. We do not control and are not responsible for third-party content, services, or terms.

25. Electronic communications & signatures

You agree to receive communications electronically (email, on-site notices). By clicking buttons such as “Pay now”, “Subscribe”, “I agree”, you provide a legally effective electronic signature (eIDAS/UK e-signature principles).

26. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control (e.g., natural disasters, strikes, carrier failures, epidemics, regulatory actions, internet outages). We will resume performance as soon as reasonably possible.

27. Assignment

We may assign or transfer our rights and obligations under these Terms. You may not assign without our prior written consent.

28. Severability & no waiver

If any provision is invalid or unenforceable, the rest remains in force. A failure to enforce is not a waiver.

29. Governing law & jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, without prejudice to any mandatory consumer protections in your EEA country of residence.
